Equipment Rental Agreement

Please use the below form to request rental equipment from Saddle Hills County. Once complete and security deposit has been received, a member of Agricultural Services will be in touch to confirm your order. Total cost will be based on the number of days and piece of equipment rented.

The Renter, shown below, agrees to rent the equipment identified in this agreement from the Agricultural Service Board (called the “Owner” in this Agreement) on the terms and conditions set out below.

  1. The Renter acknowledges receipt of the equipment and shall return the equipment, after thorough cleaning, to the Owner in the same condition as received on the return date specified in this agreement, normal wear and tear accepted. The Renter agrees to pay cleaning charges on rental equipment returned uncleaned.
  2. The Renter is responsible for any loss or damage to the equipment due to the renter’s negligence.
  3. Without limiting the remedies of the Owner, the deposit held under this agreement may be applied as follows: a) to any outstanding rental charges owing by the Renter; b) to cover the cost of any loss or damage to the equipment that occurred prior to the return of the equipment to the Owner.
  4. The equipment will be used at the Renter’s own risk. The Owner shall not be responsible for any injury, loss or damages sustained by the Renter, the Renter’s employees or agents as a result of the use of the equipment in the absence of the Owner’s negligence.
  5. The Renter shall, without limiting obligations or expense, maintain Comprehensive General Liability Insurance in the amount of not less than $1,000,000 inclusive per occurrence against bodily injury, personal injury and property damage including loss of the property. Such insurance shall include blanket contractual liability.
  6. If rented equipment is towed or hauled, the Renter shall maintain automobile liability insurance on all vehicles owned, operated or licensed in the name of the Renter in an amount not less than $1,000,000 inclusive.
  7. The Renter agrees that the rental equipment shall not be used to derive monetary gain for themselves or their company.
  8. It is the sole responsibility of the Renter to complete the “Condition of Rental Equipment” form before taking the equipment. If this form is not completed, Saddle Hills County may charge the Renter for any damages noted upon its return.
  9. Saddle Hills County will have the right to enter lands where the equipment may be located for the purpose of inspection or observing its use.
  10. The Renter has read and understands the Operating and Safety Procedures sheet for this piece of equipment, and will operate the equipment in a safe and responsible manner.
  11. The renter understands and assumes all potential risk relating to the spread of noxious and prohibited noxious weeds, pests, and disease and releases the county from any liability should any legislated invasive species be found on locations where work has been completed with County rental equipment.
